This Privacy Policy (“Policy”) outlines how NoCapp uses and protects users’ personal data obtained through the use of our services. This Policy is part of the Terms of Use and must be read alongside them.

 

Information provided by the User:

 

Account Information: To create an account on NoCapp, users must provide their mobile phone number. Without this information, it won’t be possible to create the account or use our services. This is the only data required from the user to use the application.

User Information: The only user data visible to others will be the phone number. However, this information will only appear in specific functionalities, and the application doesn’t reveal which phone number sent the message. Identifying the user with the content sent to others is only possible if the user chooses to identify themselves. No other user data collected by NoCapp, such as location, will be shared with other users.

Messages: NoCapp is a cloud-based messaging service. Messages exchanged between users are not public and can only be seen by those in the same group. When someone from the user’s contacts registers on NoCapp, and the user is in their contact list, that user will appear in the application’s contact list, allowing for message exchange and invitations. Messages are sent securely via TLS encryption.

Group Information: Users can create or join group chats. Group invitations can only be made to phone contacts already in the user’s list, and vice versa. Users can only be invited by those in their contacts and vice versa.

Contacts: NoCapp recognizes phone contacts who have the app installed and are using our services.

User Support: When contacting support, users can provide any relevant information to help resolve the issue, such as reporting offensive messages or other details to aid the process.

Account Access: When registering or logging in, we verify the user’s phone number by sending an SMS.

Automatic Information Collection

App Usage: We collect data on how users engage with our services, including:

  • User activities;
  • How services are used;
  • User interactions;
  • Activity frequency;
  • Date and time stamps;
  • Feature usage.

Device Information: We gather data on the device where the app is installed, including:

  • Hardware model;
  • OS, app version, network, mobile carrier or ISP, language, time zone, IP address, and device identifiers.

Performance: We collect performance data, including:

  • Service diagnostics and crashes;
  • App version and error logs;
  • Application and website performance.

Location: We collect data to estimate user location. If not provided, location is calculated using IP and other information.

Cookies: We may use cookies to offer our services and web-based operations.

User Settings: We collect data on user settings, including terms acceptance and push notification activation.

Data Retention: We retain message content for at least one year to:

  • Respond to legal or judicial requests;
  • Process and resolve complaints;
  • Fulfill regulatory or litigation purposes;
  • Ensure service security;
  • Protect rights and properties.

Third-party Information

 

Data from Other Users: We receive information from other users about you, such as when users you know use our services. We require all users to be aware of our Terms and Policies. Users with mutual phone contacts can send messages without identifying the sender unless they choose to.

Reports: Users can report content they find offensive. They can also report your content if deemed inappropriate. We receive information from both the reporter and the reported party. If we find that the content violates our Terms or could harm others, we may remove it, either partially or fully.

Sharing Data with Third Parties

Information to Other Users: Users control the information shared with others. When sending content, others cannot share the messages. The app blocks screenshots, and if taken externally, NoCapp is not responsible for the consequences.

Account Data: To add users to a conversation, both parties must have each other’s numbers saved in their contacts. Adding users without all participants having the numbers saved is not allowed.

 

Collaboration with Other Companies

 

We work with other companies providing legal advisory services, such as:

  • Litigation and legal processes;
  • Regulatory investigations;
  • Responses to legal and governmental requests;
  • Privacy management.

Terms and Policy Updates

 

We will keep our terms and policies updated and modify them when necessary. The user’s continued use of our services confirms acceptance of these updates.
