- About the Application
NoCapp allows the anonymous exchange of free messages among people listed in other users’ contact lists, in case the sender prefers not to be identified. By installing the app, using the services, or accessing the website, the User agrees to these Terms of Use (“Terms”).
Important:
- Zero Tolerance for Offensive or Abusive Content. Any content deemed offensive, abusive, harassing, pornographic, or that promotes illegal activities will not be tolerated and may be removed, restricted in visibility, or result in the User’s account being blocked.
- This document is intended to ensure that all use of NoCapp is carried out in a legal, safe, and respectful manner, in compliance with applicable laws and best practices for moderating user-generated content.
- Services
- Minimum Age:
- To use NoCapp, you must be at least 13 years old. In some countries, the minimum age may vary. If the user is a minor, they must have permission from their legal guardians, who must also agree to these Terms and are responsible for the minor’s actions within the app.
- Account Creation:
- The User must register their phone number to open an account.
- The User agrees to receive both anonymous and identified messages, depending on the sender’s choice, as well as app messages for verifications or important communications.
- Privacy:
- Messages sent via NoCapp are generally anonymous, unless the User chooses to identify themselves.
- Some features may display the phone number in group settings.
- The app may collect message data for advertising purposes, in full compliance with applicable legislation and with our Privacy Policy.
- Software and Updates:
- The User must keep the app updated in order to access new features and fixes.
- Costs:
- The User is responsible for the costs associated with using the app on their devices (data plans, internet, etc.).
- Use of NoCapp
- Acceptance of Terms and Policies:
- The User must use NoCapp in compliance with these Terms, our Privacy Policy, and any other published policies.
- By continuing to use it, the User expresses agreement and commitment to respect these Terms, including the Zero Tolerance policy for offensive or abusive content.
- Legal and Respectful Use:
- The User agrees not to violate laws, commit offenses, or promote or encourage hatred or discrimination based on religion, race, gender, sexual orientation, or any other characteristic.
- Bullying, harassment, stalking, threats, defamation, fraud, screen recording without authorization, recording content without the consent of all parties involved, sharing intimate content without permission, or engaging in any recognized illegal activity (including but not limited to child abuse, weapon or drug sales, incitement to violence or terrorism) is strictly prohibited.
- User-Generated Content:
- Content Filtering: NoCapp uses automated filtering mechanisms and/or manual review to attempt to prevent offensive, pornographic, or illegal content from being posted.
- Reporting Offensive Content: If the User finds content that they consider offensive or in violation of these Terms, they may report it directly through the app (via the “Report”/“Denounce” button or menu) or by sending an email to [enderecodosuporte@exemplo.com].
- Blocking Abusive Users: NoCapp offers a feature to block unwanted senders, hiding their messages and preventing further direct interactions.
- Response to Reports: The NoCapp team undertakes to evaluate and respond to reports in a timely manner, and may remove or restrict the reported content and, if necessary, suspend or close infringing accounts.
- Consequences of Violation: Any violation of these guidelines may result in suspension or permanent ban from the app, at NoCapp’s discretion.
- Account Security:
- The User is responsible for the security of their account and any activities carried out on it.
- In the event of device loss or theft, the User must reinstall the application on another device with the same phone number to disable access on the previous device.
- Access to Emergency Services:
- NoCapp does not replace calls to emergency services (police, fire department, ambulance, etc.). For emergencies, use your country’s official channels.
- Third-Party Services:
- When interacting with third-party services within NoCapp, the User must also comply with the Terms and Policies of those services.
- Licenses and Rights between Users and NoCapp
- User Rights:
- The User must ensure that the registered phone number is in their possession and allows for legal identification, if necessary.
- The User is the owner and responsible for the content they create and must ensure it does not violate third-party rights or applicable laws.
- NoCapp’s Rights:
- NoCapp holds all trademarks, logos, domains, patents, copyrights, intellectual property, trade secrets, and software related to our Services.
- The User may not use these elements without prior written authorization from NoCapp.
- NoCapp Usage License:
- NoCapp grants Users a worldwide, royalty-free, personal, limited, revocable, non-exclusive, and non-transferable license to use our Services in accordance with these Terms.
- Disclaimer and Limitations
- Disclaimer:
- The User uses the Services at their own risk.
- The Services are provided “as is,” without any express or implied warranties.
- NoCapp is not responsible for failures, errors, interruptions, improper use, security failures, incorrect information, viruses or malicious code, or any data loss resulting from the use of the app.
- We are not responsible for other Users’ behavior or content.
- Limitation of Liability:
- NoCapp will not be liable for losses or damages resulting from the use or inability to use the app.
- We are not liable for incidental, indirect damages, or loss of profits.
- If applicable law does not allow certain limitations, NoCapp’s liability will be limited to the maximum extent allowed.
- Availability of Services
- We may interrupt or change our Services for updates, maintenance, or other reasons.
- We may discontinue part or all of the Services at any time, without prior notice, if necessary for technical, legal, or strategic reasons.
- Dispute Resolution and Termination of the Terms
- Termination of the Terms:
- The User may terminate these Terms at any time by removing the app from their devices and ceasing its use.
- We may suspend or terminate the User’s access if these Terms are violated or if there is a risk or legal implication for NoCapp.
- Even after termination, certain sections will remain in effect (for example, “Licenses,” “Disclaimer,” etc.).
- General
- Revisions to the Terms: We may revise these Terms periodically. The “Last Modified” date will be updated, and continued use of the Services confirms acceptance of the revisions.
- Export Laws and Other Restrictions: The User must comply with all applicable export, anti–human trafficking, and trade sanctions laws.
- Respect for Third-Party Rights: The User must respect the rights of third parties, including privacy, image, and intellectual property.
- Entire Agreement: These Terms constitute the entire agreement between the User and NoCapp, superseding any previous versions.
- No Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it in the future.
- Severability: If any provision is found to be invalid, it will be severed from these Terms without affecting the remaining provisions.
- International Distribution: Our Services are not intended for distribution or use in countries where such distribution violates local laws. We may restrict our Services in any country at our discretion.
